
What is medical negligence?

Conditional fee agreement (No Win No Fee):
If the medical negligence claim is unsuccessful, the solicitors will waive the legal fees and not charge for any work that has been carried out. If your negligence claim is successful, they can recover the majority of the legal fees from the defendant.
Legal expense insurance:
If you have a household insurance policy then it may be that there is a provision for legal expense insurance, which can be used to pay the medical negligence solicitors fees.
Legal Aid:
To be eligible for legal aid the criteria set down by the Legal Service Commission has to be met. The solicitor can apply for funding if the case has a reasonable prospect of success and, if you have no income or if the medical negligence claim is made by an infant or mental heath patient. The funding could then cover either the investigation help or full representation.
Private Funding:
This is where the medical negligence solicitors will act for you on a private basis. The solicitor will agree to work on either an hourly rate or on a fixed budget to cover specific work.
